Chansley did a plea deal with the prosecutors, but should he have?
We are starting to understand why the Democrats did not want to release the tapes of January 6. Did Merrick Garland and DOJ Prosecutors fail to disclose video showing Jacob Chansley being escorted peacefully by Capitol Police on January 6? It sure looks like it. Prosecutors have a duty to disclose all exculpatory evidence to the defense. Chansley was sentanced to 41 months. At a minimum, he should get a new trial and under most cases he would be released.
Andrew McCarthy sees nothing exculpatory in the video. Really? I could, at a minimum, see a jury responding differently to that video or a judge invoking a sentance less than 41 months. Professor Jacobson (granted not a criminal law professor) sees it differently:
Maybe it wouldn’t have made a difference, but that’s not the standard. The government has to turn over all potentially exculpatory evidence. At a minimum the video is partially exculpatory as to the severity of Chansley’s conduct and could have factored into sentencing.
