Ahmaud Arbury case and the danger of taking the law into your own hands...



Obviously the McMichaels have not be tried and found guilty yet, but the evidence suggests they will probably be going to prison for a very long time. What broke this case open was the video recorded by their other neighbor William "Roddie" Bryan.  It appears local authorities were reluctant initially to prosecute a retired police officer, although part of the delay is due to the local district attorneys having to recuse themselves (because they had connection to McMichael).

If things were moving slowly before, that changed this week. The State of Georgia and Georgia Bureau of Investigation intervened and the McMichaels have been charged, arrested, and are being held without bond. With public outrage over this shooting building, the facts will we revealed on what really happened in this case.

If you do own a gun, I strongly suggest you educate yourself on when using one is approrpiate. A civilian using a firearm to chase down a suspect they think may have committed a property crime is almost always a very bad idea. In the Michaels Arbury case it led to the death of one man (who appears completely innocent but we need to see how the facts play out) and the McMichaels making a series of very bad decisions that will almost certainly destroy their own lives (as noted the process of being accused, arrested, and trial is pretty harsh even if eventually acquitted).

If you own a firearm, you should be knowledgable about the laws in the state you live in. A good first step is reading Andrew Branca's blog The Law of Self Defense and getting his books (or taking his courses). Andrew Branca did an after action analysis of this shooting (you need to sign up for his blog to access it--and you should do so).

Update:  I said above the McMichaels are probably facing going to prison. I still suspect that is the case, but that ultimately depends on the trial and the evidence. Andrew Branca gives a very good break down in his after action analysis. The key to McMichaels's defense is whether the initial action of chasing Arbury was reasonable. The media reports (as is typical) are not to be trusted.  This is not just a case of media bias (although that is a factor) but there are just a lot of conflicting "facts" presented. Reporters are just reporting what others say to them. Until law enforcement  and the Georgia Bureau of Investigation sorts that out we just don't know enough.
