Legal Insurrection: Trump's Only Option
Professor Jacobson lays out President Trump's options if he declares a national emergency. I do not buy the slippery slope or what some Democrat president might do arguments (frankly it should have been done in the House and then the Senate should have waived the filibusters to get it through). The border is a serious issue and if the President has the authority to divert funding to it he should do it. Given there is another caravan coming, the President has some additional justification for doing so.
Of course, I am sure the left will find a friendly judge or two to issue an injunction on the executive, but given a statute authorizing this authority and the President's inherent powers to control borders, I suspect he can get at least five justices to back him on this.
An expedited Supreme Court test would be right in the middle of the election primaries.

ReplyDeleteOf course, by the time the SCOTUS reviews it, if they do, it will be after the 2020 election. Plus, he can't count on some of the so-called conservative justices to vote in his favor. Even if RBG is dead and buried.
