Why isn't Democrat Rene Boucher facing more serious charges for attacking Senator Rand Paul?

I am sure politics was a motivation in this attack (and that escalates potential sentencing penalties considerably), but regardless Rene Boucher blindsided Rand Paul and seriously hurt him. That alone should warrant serious felony charges (whether they get negotiated down is between the prosecutor and the defense lawyer). The idea that is ok for Democrats to attack Republican officials needs to be completely rejected.

The media have mostly been shameless, carrying water for Boucher and trying to blame the victim.  Turns out the Pauls are nice neighbors who get along with everyone in the community (except Boucher). But even if they weren't, blindsiding someone while they have earphones and seriously injuring them warrants serious charges.
